Jammu and Kashmir High Court passed on Saturday directed authorities to shift a detainee Nazir Ahmad Shah of Urpara Nagbal village in Shopian in south Kashmir from Kathua district jail in Jammu to Central jail Srinagar.

Nazir has been booked under draconian Public Safety Act (PSA) after remaining under “preventive” detention since July 9, 2016.

His case is being pleaded by his wife Shabnam, who is in the third trimester of pregnancy.

The court issued the order on the grounds that the expectant mother submitted, “she is not in a position to undertake long journeys, like the one on the Srinagar-Jammu highway. In case she undertakes such journey, it will have fatal results on the expecting child in terms of the medical evidence.”

The Court, in its order directed Shopian District Magistrate, to consider the lodgement of the detainee in Central Jail, Srinagar, by modifying his order of detention to this extent.

“In case, the magistrate fails to do the needful, the Superintendent, Central Jail, Kathua, shall ensure presence of the detainee before the court on the next date of hearing fixed on October 27,” the court said.
