Prompted by the requests of parents of persons arrested during the 2016 summer uprising who have been lodged in jails away from their home districts, the Jammu and Kashmir Bar Association conducted the annual jail visit of jails in Jammu region on November 24-26, 2016 in pursuance of orders issued by the High Court (in MP No: 1 in OWP No: 767/2006 case titled High Court Bar Association vs State of J&K & Ors). A team of lawyers comprising of Advocate Arshad Andrabi, Ad Mohammad Ashraf Bhat, Ad Mohammad Shafi Reshi and Ad Mushtaq Ahmad Dar visited the District Jail Udhampur on 26th November 2016. Various issues relating to welfare of detenues in the state jails were raised in this public interest litigation petition and the Hon’ble Court has passed various orders and directions from time to relating to welfare and wellbeing of the inmates especially the category of political detenues incarcerated by the reckless use of draconian laws like J&K PSA etc.

According to the figures available the number of inmates category-wise include:

Convicts (Rigorous Imprisonment) – 5 males and one female – total 6

Convicts (Simple Imprisonment) – 1 male – total 1

Under-trails (C/L) – 235 males, 19 females – total 254

Under-trails (militants) – 19 males – total 19

Detenues (militants) – 9 males – total 9

Detenues (ordinary) – 26 males – total 26

So the total number of inmates in the jail are 315 including 295 males and 20 females. Besides there are three infants lodged in the jail who are not included in the lockup.                                    .

Udhampur jail is one of the overcrowded jails of the state. Against a maximum capacity of 263 there are 315 inmates in the prison. A doctor from the local hospital is put on call in addition to his own duties. He usually visits the jail once in a week. The inmates however, were satisfied about the provision of medicine in the jail. The jail staff including the Superintendent  Harish Kotwal and Dy Superintendent Mohammad Ibrahim were cooperative and facilitated the visit of the lawyers team and their interaction with the inmates. A computerized list of 9 detenues related to militancy related cases and a list of 24 detainees shown to have been lodged under Common law was provided.

After looking at the condition of the jail and interacting with the inmates, it was observed that the inmates in this jail are feeling frustrated and are under mental stress due to the fact that they have been lodged in a jail far away from their home places / districts and it becomes difficult for their family members, relatives and friends to have interaction with them.

Besides, they feel that there is neither any progress in the trials of cases registered against them in various police stations, nor are they satisfied about the progress of Habeas Corpus petitions filed on their behalf in the High Court. The Government is issuing orders of extension in the period of their detention and these orders are not communicated to the detenues, their families and their lawyers resulting in the prolongation of their detention despite expiry of the period of their detention ordered in the initial order and even after quashment of the detention orders by the High Court.

The case of Abdul Majid Mir S/o Abdul Rehman Mir R/o Naseer Abad [B] Chinkipora Sopore is a case in point. The detenue was ordered to be lodged in District Jail Udhampur for a period of three months   vide Order No: 66/DMB/PSA/2016  dt: 10.8.2016 . The period of detention expired on 13.11.2016 but the detention has been extended vide G.O. Order No: Home /PB-V/1955/2016 dt: 11.11.2016 for a further period of three months. This order was not communicated to the detenue and does not find a mention in the order of qaushment passed by the Hon’ble High Court which has declared the detention illegal but he is not being released until the High Court order makes a mention of the order of extension. In this way several detenue have to remain inside jail premises despite their order of detention having been declared illegal by the High Court.

The prolonged detention in this manner is a defiance of the court orders and amounts to a failure of due process and rule of law in the state. This is a serious reflection on the state of rights of citizens in the state who have to face incarceration under draconian preventive laws like J&K PSA which has been declared as a “Lawless Law” in the Amnesty international Report in 2010.  This law has been used recklessly during the present summer and numerous citizens have to remain behind the bars far away from their homes . This law has the effect of defeating the trials of the criminal cases registered in local police stations as the detenues are rarely brought to court to face their trails. It was found that this jail is one of the overcrowded jails which lacks most of the basic facilities.

As per the facts revealed in the interviews of detainees and discussions held with jail authorities it was a surprise to learn that no inmate has been taken to any court during the year 2016.The main reason being that the jail authorities are at the mercy of District Police to provide escort to take detneues to the court premises on due dates, but due to lack of escort facilities the presence of the detainees in the courts on due dates becomes impossible and their trials get prolonged. This situation has resulted not only in a failure of justice and a denial of basic rights of citizens to a fair and speedy trial but also to a frustration amongst the inmates.

The under trials who had interaction with Bar team were:

Ishfaq Ahmad Sofi @ Umar S/o Mushtaq Ahmad Sofi R/o Model Town Sopore. Age;27 yrs . He is in possession of Diploma in Computer Hardware & Software. Having family responsibility of supporting his parents , brother and sisters , he is incarcerated since the month of January 2016 when he was arrested by Sopore Police and thereafter DM Baramulla passed order No:12/DMB/PSA/2016 dt:18.3.2016 ordering his detention for a period of 12 months which is expiring in March 2017. His trial in  the case FIR No:193/15 P/s Safakadal u/s 307 RPC and 7/25 A A Act  was never started due to overlapping order of detention under PSA. Having been lodged in a region away from his homeplace his family could not arrange to meet him even once in this jail. A case of lack of adequate legal aid and insufficient legal defense to an incarcerated young man in his prime youth. He has given his contact numbers 9906634950 and 9419034173

Shabir Ahmad Mir @ Shabir Maulvi S/o Mohammad Sultan Mir R/o Model Town Baramulla . Age : 27 yrs. Presently , he is detained under PSA for the charges of being an “ Overground  Worker” . He is a Hafiz Kalamul Allah.  He spends most of the time in jail while reading, reciting and teaching Quran. He has brought of number of books from his home and is also taking advantage of the collection of the books available in the jail library. Instead of allowing him to defend any charges against him in a trial court, he is booked under K&K PSA away from his home place. DM Baramulla has passed order No: 26/DMB/PSA/2016 dt: 31.5.2016 ordering his detention for a period of six months which is expiring on 2.12.2016 .  This kind of treatment to citizens speaks of a colonial mind set and is against the concept of rule of law and human dignity.

Ubaid Tariq Untoo S/o Tariq Ahmad Untoo R/o Kralteng Sopore is another detenue who is undergoing detention under PSA orders issued by DM Baramulla Vide Order No:32/DMB/PSA/2016 dt: 03.06.2016 ordering his detention for a period of 6 months which is expiring on 4.12.2016. He is lodged in jail since 5th June 2016.

Abdul Ahad Rather S/o Abdul Gani Rather R/o Tarzoo Sopore . Age: 42 yrs Qualif: M.A Arabic – Hafiz , Qari and Mufti. He is in detention since 18.5.2016. An unaccounted for period from 18.5.2016 till 06.06.2016 is a period of his illegal detention.  DM Baramulla Vide Order No: 33/DMB/PSA/2016 dt: 03.06.2016 ordering his detention for a period of 6 months. This order is shown to have been executed on 6.6.2016 and is expiring on 5.12.2016. Hon’ble High Court has quashed his order of detention and the same was served upon the jail authorities. But the jail authorities state that the State Government has ordered an extension in the period of detention and the High Court does not make a mention of that order of extension ,therefore they have not released him from custody. This is a case of contempt of court. When the detention is declared illegal the extension of illegal order also is automatically deemed to be illegal but this kind of logic is not acceptable to jail authorities. The family members when contacted stated that they have brought the matter in the notice of the court.

Mohammad Sidiq Lone S/o Mohammad Sultan Lone R/o Lorihama Sopore. Age: 30 yrs is a highly qualified political detenue possessing the qualification of  M.A; B.Ed , M.Phil + P.G DRD. DM Baramulla Vide Order No: 59/DMB/PSA/2016 dt: 08.08.2016 . Appears to have been arrested on political reasons than for genuine concerns of maintaining law and order.   Besides he is also booked in case FIR’s registered in P/S Sopore , the trials of which have been scuttled by detaining him under PSA away from his home place. With the result no progress was achieved in trial for the last one year. This is a serious issue of general importance, where the due process of law is defeated by resorting to reckless use of draconian laws like PSA, when is already booked under Special laws like U L {P} Act which clothes the state with ample powers to curtail the freedom of an individual. By resorting  to provisions of PSA concurrently , the state is jeoparadizing the judicial process through passing of orders of administrative detention , which practice is condemned universally.  During the year he has had only one interview with his family members due to prevailing situation and their inability to travel long distance.

Abdul Qayoom Ganaie S/o Mohammad Sultan Ganaie R/o Nadihal Rafiabad Baramula. Age: 30 yrs. Initially arrested by Police station Panzila Rafiabad on 29.6.2016. Was retained in illegal and unaccounted for custody by SOG for about two months, then shifted to sub jail Baramulla for days and shifted to Udhampur on 14.8.2016. DM Baramulla Vide Order No: 60/DMB/PSA/2016 dt: 08.08.2016 ordering his detention in Udhampur jail. The period of detention has not been mentioned by the jail authorities. It appears to be a case of extended detention and his ordeal is not going to end soon.

The detenue was ordered to be lodged in District Jail Udhampur for a period of three months vide  Order No: 66/DMB/PSA/2016  dt: 10.8.2016 . Lodged in this jail since 14.8.2016. The period of detention expired on 13.11.2016 but the detention has been extended vide G.O. Order No: Home /PB-V/1955/2016 dt: 11.11.2016 for a further period of three months. Another category of detainees from Kashmir valley have been included in the category of Common Law Detenues who are booked in cases registered in various police stations and are supposed to be facing trials in local courts but are concurrently booked under the provisions of J&K PSA are ordering their lodgement away from their home places, has resulted in defeating of the judicial process and consequent failure of  rule of law.

Mehrajuddin Naikoo S/o Abdul Rashid Naikoo R/o Seelo Sopore. Age :37 yrs. His party affiliation is shown as ‘Hurriyat [G] Stone Pelter.  Arrested on 17.7.2016 by P/S Sopore, the detenue remained in  custody till 07.8.2016. The detenue was ordered to be lodged in District Jail Udhampur for a period of six months   vide  Order No: 52/DMB/PSA/2016  dt: 02.8.2016 . Lodged in this jail since 07.8.2016. The period of detention is expiring on 06.02.2017. He has a family responsibility of supporting his old parents, spouse three brothers and four minor children . Did not get adequate legal aid and attention. No progress in criminal trial possible due to incarceration away from home place. Wants the team members to contact family on phone and inquire progress of the cases pending .

Mohammad Ashraf Malik S/o Abdul Malaik R/o Warapora  Sopore. Age: 60 yrs. His party affiliation is also shown as ‘Hurriyat [G] Stone Pelter.  Arrested on 24.7.2016 by P/S Soporre, the detenue remained in custody till 07.8.2016. The detenue was ordered to be lodged in District Jail Udhampur for a period of six months vide Order No: 53/DMB/PSA/2016  dt: 02.8.2016. Lodged in this jail since 07.8.2016. The period of detention is expiring on 06.02.2017. He has a family responsibility of supporting his old and infirm mother aged 90 yrs, spouse and four daughters. On the date of his arrest his only son Aejaz Ahmad was going to be married. This old man of 60 years is huddled in an overcrowded jail in Barrack No: UT-3 where basic facilities of toilet, sanitation and hygiene are scant. The food provided to the detneues is only vegetarian comprising of Dal and Sabzi which is not cooked properly. Did not get adequate legal aid and attention. No progress in criminal trial possible due to incarceration away from home place. Wants the team members to contact family on phone and inquire progress of the cases pending.

Nazir Ahmad Ganai S/o Haji Habibullah Ganai R/o Dangerpora  Sopore. Age: 65 yrs. His party affiliation is also shown as ‘Hurriyat [G] Stone Pelter.  Arrested on 24.7.2016 by P/S Sopore, the detenue remained in custody till 07.8.2016. The detenue was ordered to be lodged in District Jail Udhampur for a period of six months vide Order No: 54/DMB/PSA/2016 dt: 02.8.2016. Lodged in this jail since 07.8.2016. The period of detention is expiring on 06.02.2017. He has a family responsibility of supporting his four offspring. This old man of 65 years is huddled in an overcrowded jail in Barrack No: UT-3 where basic facilities of toilet, sanitation and hygiene are scant. The food provided to the detneues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. Nazir Ahmad War S/o Mohammad Ramzan War  R/o Asthanpora- Warpora   Sopore. Age: 51 yrs. His party affiliation is also shown as ‘Hurriyat [G] Stone Pelter.  Arrested on 24.7.2016 by P/S Sopore, the detenue remained in custody till 07.8.2016. The detenue was ordered to be lodged in District Jail Udhampur for a period of six months vide Order No: 56/DMB/PSA/2016  dt: 02.8.2016. Lodged in this jail since 07.8.2016. The period of detention is expiring on 06.02.2017. He has a family responsibility of supporting his four offspring . This old man of 51 years is huddled in an overcrowded jail in Barrack No: UT-3/4 where basic facilities of toilet, sanitation and hygiene are scant. The food provided to the detneues is only vegetarian comprising of Dal and Sabzi which is not cooked properly. Did not get adequate legal aid and attention. Mohammad Rustum Bhat S/o Haji Mohammad Bhat R/o Amargarh Sopore. Age: 65 yrs. His party affiliation is also shown as ‘Hurriyat [G] Stone Pelter.  Arrested on 24.7.2016 by P/S Sopore, the detenue remained in custody till 07.8.2016. The detenue was ordered to be lodged in District Jail Udhampur for a period of six months vide Order No: 57/DMB/PSA/2016  dt: 02.8.2016 . Lodged in this jail since 07.8.2016. The period of detention is expiring on 06.02.2017. He is an elderly man who is respected in his locality and is head of the local Traders Federation. It appears that that he has been booked under PSA for political reasons and this 65 year elderly man cannot be involved in Stone pelting as is alleged in the official records. He has been also huddled in an overcrowded jail in Barrack No: UT-3/4  where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detneues is only vegetrain comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and medical attention. No progress in criminal trial possible due to incarceration away from home place. Wants the team members to contact family on phone and inquire progress of the cases pending .

Aqib Hussain Shah S/o Mohammad Abdullah Shah R/o Papchan Bandipora. Age :19 yrs . He is classified as a Stone Pelter.  Arrested on 20.7.2016 by P/S Bandipora , the detenue remained in  custody till 12.8.2016. The detenue was ordered detained under the orders of DM Bandipora and to be lodged in District Jail Udhampur for a period of six months   vide  Order No: 06/DMB/PSA/2016  dt: 09.8.2016 . Lodged in this jail since 12.8.2016. The period of detention is expiring on 11.02.2017. He has a family responsibility of supporting his parents and minor brothers and sisters. This young man si lodged in an overcrowded jail in Barrack No: UT-3/4 where basic facilities of toilet, sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly. Did not get adequate legal aid and attention. Lodged in this jail since 12.8.2016. The period of detention is expiring on 11.02.2017. He has a family responsibility of supporting his parents and minor brothers and sisters. He is also lodged in this overcrowded jail in Barrack No: UT-3/4  where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. Tariq Ahmad Malik S/o Ahmad Malik R/o Kangan- Ganderbal ,Age :37 yrs.  He is classified as Hurriyat {G} Stone Pelter.  Arrested on 20.8.2016 by P/S Kangan  , the detenue was kept in police custody without remand till 30.8.2016, when he was ordered to be detained under the orders of DM Ganderbal and to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 111/DMG/PSA/2016  dt: 27.8.2016 . Lodged in this jail since 30.8.2016. The period of detention is expiring on 29.11.2016. He has a family responsibility of supporting his minor children. He is also lodged in this overcrowded jail in Barrack No: UT-4  where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. He is trying to continue his disrupted studies as some teachers/lecturers from Education Deptt have  been deployed in Jail to help such detainees. Imran Khan S/o Ahad Khan R/o Bonapora , Trehgam Kupwara – Age; 26 yrs. He is classified as Stone Pelter.  Arrested on 07.09.2016 by P/S Trehgam , the detenue was ordered to be detained under the orders of DM Kupwara  to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 27/DMK/PSA/2016  dt: 08.09 .2016 . Lodged in this jail since 10.09.2016. The period of detention is expiring on 10.12.2016. He has a family responsibility of supporting his old aged parents , 5 sisters and spouse with minor children. He is the sole bread earner in the family. He is only is also lodged in this overcrowded jail in Barrack No: UT-4 where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. He is classified as Stone Pelter.  Arrested on 07.09.2016 by P/S Trehgam   , the detenue was ordered to be detained under the orders of DM Kupwara  to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 29/DMK/PSA/2016  dt: 09.09 .2016 . Lodged in this jail since 10.09.2016. The period of detention is expiring on 10.12.2016. He has a family responsibility of supporting his old aged parents, 5 sisters and spouse with minor children. He is the sole bread earner in the family. He is only is also lodged in this overcrowded jail in Barrack No: UT-4 where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. No progress in criminal trial possible due to incarceration away from home place. Wants the team members to contact family on phone and inquire progress of the cases pending. Ishfaq Ahmad Bhat S/o Abdul Rashid Bhat R/o Batapora-Lalpora , Lolab , Kupwara – Age; 24 yrs. He is classified as Hurriyat [G] Imran Khan  S/o Ahad Khan  R/o Bonapora , Trehgam Kupwara – Age; 26 yrs. He is classified as Stone Pelter.  Arrested two months and ten days back .The detenue was ordered to be detained under the orders of DM Kupwara to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 30/DMK/PSA/2016  dt: 10.09 .2016 . Lodged in this jail since 16.09.2016. The period of detention is expiring on 16.12.2016. He has a family responsibility of supporting his old aged parents , 5 sisters and spouse with minor children. He is the sole bread earner in the family . He is only is also lodged in this overcrowded jail in Barrack No: UT-4  where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly. Did not get adequate legal aid and attention. No progress in criminal trial possible due to incarceration away from home place. Nobody could come to meet him in this jail due to proverty and lack of  resources. Wants the team members to contact family on phone and inquire progress of the cases pending. During his detention nobody from his family could meet him so far. Complained about adequate sports facilities in jail.

Tariq Ahmad Panzoo S/o Mohammad Amin R/o Nabipora Ward No:5 Bandipora – Age; 22 yrs. He is classified as Stone Pelter/Instigator.  Arrested on 18.07.2016 by P/S Bandipora  , the detenue was ordered to be detained under the orders of DM Bandipora  to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 30/DMB/PSA /2016  dt: 12.09.2016 . Lodged in this jail since 21.09.2016. He has a family responsibility of supporting his old aged parents ,  sisters and spouse with minor children. He is the sole bread earner in the family. He is also lodged in this overcrowded jail in Barrack No: UT-4 where basic facilities of toilet, sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly.  Did not get adequate legal aid and attention. No progress in criminal trial possible due to incarceration away from home place. Wants the team members to contact family on phone and inquire progress of the cases pending. During his detention nobody from his family could meet him so far. Complained about adequate sports facilities in jail. There is no space in jail to arrange a game like volleyball or football.

Abdul Rashid Wani S/o Abdul Aziz Wani R/o Maidan Chowgal Handwara, Age-66 yrs. Has qualified his B.A; LL.B degree in the year 1971. He has been classified as Hurriyat [G] Instigator. Arrested on 9.7.2016 and kept in police custody. He states that there was tension in the town and he decided to close his medical shop. The forces came and tried to arrest the boy working in his shop. He asked them not to arrest him and instead may take him into custody. The security personnel obliged him by arresting him then and there without any apparent excuse. He was taken to CIK Interrogation centre where he was subjected to abuses and mental torture at the hands of officials belonging to migrated minority community.  Later on the detenue was ordered to be detained under the orders of DM Kupwara to be lodged in District Jail Udhampur for a period of three  months   vide  Order No: 33/DMK/PSA/ 2016  dt: 19.09 .2016 . Lodged in this jail since 21.09.2016. He has a history of complicated medical problems. He is suffering from  Diabetes- Type 1[requiring Insulin] , Diminishing eyesight, Hypertension , Neurological operations performed on him, and his has been three times operated upon for disc problems in L-4,L-5 and S-5.

Due to these ailments he is not able to bend down and perform normal  life functions. He cannot even perform daily washing and cannot perform wuzu  without the help of his fellow inmates. Since he is medical practitioner, he has been asked to help inmates by prescribing and administering medicine etc to the other ailing inmates as no permanent doctor is posted in this jail.    He is only is also lodged in this overcrowded jail in Barrack No: UT-3-4  where basic facilities of toilet ,sanitation and hygiene are scant. The food provided to the detenues is only vegetarian comprising of Dal and Sabzi which is not cooked properly. Did not get adequate legal aid and attention.
