In an embarrassment to the Jammu and Kashmir Cements Ltd, the High Court of Jammu and Kashmir has issued an arrest warrant against the Managing Director, Financial Advisor, General Manager and Manager Administration of JK Cements seeking their appearance on December 16 in a contempt of court case.

The copy of arrest warrant in possession of KNS reads, “The arrest warrant is issued against the MD and others on a petition by Bilal Ahmad Wani and others, alleging that the officials discharged their duties in violation to the rules and managed to regulate some of the other some daily wagers. The officials have failed to take a decision against the directions of the court which is considered as the contempt of court. The MD and others have been asked to appear before court December 16.”

In its judgment No 11760 dated 20. 3 2014 Justice Hasnain Massodi, against the writ petition by Bilal Ahmad Wani and others said “Petition claim to have been engaged vide order no.JKCL-PW/J/14/2013/315 dated 28.10 2013 in the respondent Corporation on daily wage basis and to have been discharged their duties to the satisfaction of the management.”

They are aggrieved that while the service of some of the similarly circumstanced workers/employees in the respondent corporation have been regularized, petitioners are not been considered for regularization and have been exposed to discriminatory treatment

The judgment further reads that the learned counsel for the petitioner’s states that petitioners confident of merit in their claim would feel dissatisfied at this stage, in case the writ petition is disposed of a direction to the respondents to accord consideration.

It further reads “In view of the case setup and stand taken by the learned counsel for the petitioners the writ petition is disposed of with the directions to the respondents to accord consideration to the petitioners claim for regularization and take a decision in the matter within eight weeks from the date of receipt of copy of this order. Till the petitioners claim is considered, their present status will not be disturbed.”

Sources told KNS that the disengaged persons had registered their complaint to district magistrate Srinagar, but no action was taken following which they took the legal route and filed a case in the High court.
