J&K Government has accorded sanction for prosecution against the Deputy Superintendent of Police Noor-ul-Hassan Parray, allegedly involved in Khanabal twin killings of 2010.

The order issued by Home Department vide order number Home/Pros/12/2016, said that during the course of investigation the Investigating Officer has established, prima facie, a case under section 304-11 of RPC against Parray.

“In exercise of the powers conferred by subsection (1) of section 197 of the Code of Criminal Procedure, Svt. 1989, the State Government hereby accords sanction for launching prosecution against the accused person namely, Noor-UL-Hassan Parray (Dy.S.P) S/O Gh. Hassan Parray R/o Brinal Lammer for the commission of offence punishable under section 304-II RPC, arising out of FIR No. 361/2012 of Police Station, Anantnag,” reads the order, a copy which lies with KNS.

It said that on 13.09.2010, during the maintenance of law and order situation in Khanabal area, some youth including Maroof Ahmad Nath @ Raju while fleeing jumped into River Jhelum and the he drowned. “The body of said person was recovered on 18.09.2010 and was carried in the shape of a procession towards Khanabal, then to KP Road and finally towards Delhi Darbar,” it reads.

“However, when the procession was stopped from entering Anantnag town, as restrictions were imposed in that area, the miscreants resorted to heavy stone pelting and the mob turned violent, resultantly, few shots were, reportedly, fired in air to control the mob, due to which some persons got injured and the procession returned towards Khanabal via Nai-Basti. Out of the injured, two persons Bilal Ahmad Najar and another person Noor-ul-Amin Dagga succumbed to their injuries,” it adds.

It said that with regard to the firing incident near Delhi Darbar, case FIR No. 355/2010 was registered in Police Station, Anantnag and subsequently father of one of the deceased persons approached Court for registration of a separate case, with the plea that the deceased persons were injured in the firing incident near Ahli Hadees Masjid, Khanabal, and not near Delhi Darbar.

“In this connection, a separate case FIR No.361/2012 under section 302 RPC was registered at Police Station, Anantnag, after judicial intervention with the further direction to constitute a Special Investigation Team, and as such investigation was initiated,” it adds.

It said that during the course of investigation, conducted by Special Investigation Team (SIT) constituted in the matter, statement of witnesses was recorded and as many as 27 independent witnesses named Dy SP Noor-ul-Hassan Parray as accused in the case, adding, “highlighting his role in the said incident that had taken place near Ahli Hadees Masjid, Khanabal and the details regarding the deployment of nafree, that was obtained from concerned agencies the accused was in the said area on the date of incident.”

It said that during the course of investigation, on the basis of the statements of witnesses, the seizure memos and other evidence, the Investigating Officer has established, prima facie, a case under section 304-11 of RPC against the accused.

“The appointing authority of Noor-uL-Hassan Parray (Dy SP) in the Government in the Home Department and the offence has been committed by the accused person while acting or purporting to act in discharge of his official duties and to prosecute him, sanction u/s 197 (1) J&K Cr.P.C. is mandatory,” it adds.

Families of the victims and eyewitnesses say they were killed in unprovoked police firing when the two were waiting outside Ahli Hadees Masjid at Khanabal to join the funeral prayers of Maroof Ahmad Nath, who had drowned in river Jehlum after forces chased some boys.
